Odysse Battery Extended Warranty: 4th and 5th Year

 

1.    Extended Warranty Plan (“Plan”)

This extended warranty program is brought to you by Odysse and governs the support process for covered inherent electrical breakdown/ defects to the extent provided by the manufacturer’s warranty for the battery of Odysse Electric vehicles (“EV") sold by Odysse through its official sales channels in India and in its original packaging. This Plan is not valid for any EV that is either refurbished or purchased by a customer post a return from the first customer. This Plan can be availed only by the first purchaser from Odysse Dealer or (First end user) of the EV before any malfunctioning or default occurs in the EV.

 

2.    Plan Coverage Duration

2.1.Coverage begins from the next day after the expiry of the Manufacturer’s Warranty i.e. 3 years for the battery of Electric vehicle and ends on completion of 730 days from the Plan start date (“Coverage Period”)

2.2.This Plan can be purchased only within 365 calendar days of the original purchase of the Electric vehicle or within a shorter period until the Plan is available for purchase, and subject to the Electric vehicle being in its perfect working condition.

2.3.The Plan can be purchased from Odysse authorised dealers and will be automatically activated upon successful login and payment of Plan Fee, subject to validation of EV eligibility by Odysse.

2.4.The terms of this Plan, the original sales receipt for your Plan, the proof of your identity, the indemnification you provide about the working condition of the Electric vehicle before the purchase of the Plan and the Plan Confirmation form an integral part of your Plan.

2.5.The Extended Warranty coverage provided under the Plan is additional warranty time extension of 24 months to the coverage provided by the manufacturer’s hardware warranty period.

2.6.Unlimited number of Claims up-to the Covered Value (defined in clause 3.4) of the EV at the time of claim being raised are allowed during the term of the Plan. All subsequent claim requests shall be considered for paid repair only.

 

3.    Coverage Details

3.1.Customer

3.1.1.    The purchaser of the Electric vehicle whose name is mentioned on the original invoice is the Customer (herein referred to as “Customer”/”You”/”Your”). The purchaser’s spouse, children, parents and siblings or the recipient of the Electric vehicle as a gift can also be the user of the Electric vehicle subject to the fulfilment of the conditions mentioned in the terms and conditions herein. If the purchaser is a company, the Customer shall mean any representative/employee of the company authorised to use the Electric vehicle

3.2.Plan Types

3.2.1.    It is the responsibility of the Customer to purchase the correct Plan as per the Odysse (Electric vehicle) for which the Plan is being purchased. Odysse reserves the right to reject the repair request if the Plan purchased by the Customer does not match with the corresponding model of Odysse Electric vehicle or its serial number.

3.3.Extended Warranty Cover

3.3.1.    If the battery of the EV is replaced under this Plan, the original battery of the EV shall not be returned to the Customer and only the replacement product is your (Customer’s) property, and the coverage for the remaining period of the Plan shall expire after the replacement as the Covered Value is exhausted upon replacement (refer clause 3.4 for definition of Covered Value).

 

3.3.2.    Any such replacement will immediately terminate this policy with no refund of the premium and Odysse, its subsidiary or any party acting on its behalf shall not have any further obligations for the remainder of the term of this Plan. The replacement model will be with the same level or better technical specifications than the original covered battery of the EV even though the retail value of the replacement model may be lower than the previous retail value of the original covered electric vehicle. Due to technological advances, the replacement product may be of lower retail value than the original Product.

 

3.4.Covered Value

3.4.1.    Maximum Covered Value is equivalent to the residual value of the battery of the  EV as mentioned in the table below. Claim limit is unlimited repairs (up-to the covered amount) or, one replacement instance of your Battery. If the repair or replacement charges are more than the Covered Value, the customer will receive the Covered Value as the complete settlement of the claim under this plan. The total of all benefits paid or payable under this plan while it is in force shall not exceed the original purchase price paid/payable by the Customer for the battery under this Plan. Battery Coverage will be administered as per the Manual and additional conditions referred below.

4.1.  Scope of Coverage

Provided the battery of the EV is handed over to Odysse or its authorized channels in its entirety during the Claim Process and that the Customer has submitted the documents as desired under the Plan and have purchased the Electric vehicle from official sales channels of Odysse branded electric vehicle in India, the following conditions would be covered:

4.1.1.    The Plan provides cover for Extended Warranty which commences on the next day of expiration of Manufacturer’s Original Warranty for a period of 730 days thereon as per the Plan purchase

4.1.2.    The Plan provides coverage for cost of parts and labour in respect of the battery of the Electric vehicle for covered inherent electrical breakdown/defects to the extent provided by the manufacturer’s warranty for the battery sold through Official Channels of Odysse branded electric vehicle and supported by an invoice and Manufacturer’s Warranty/Guarantee

4.1.3.    Odysse and its subsidiary or any party acting on its behalf reserve the right to revise the Plan Fee at any time during the term of the Plan. However, any customer who has paid the necessary Plan Fee and activated the plan before such revision shall not be impacted by the revision in the Plan Fee

 

5.    Exclusions

The Plan will not cover:

5.1.  Plan purchased beyond 365 days of the purchase of the Electric vehicle

5.2.  Plan shall not extend to any other part/ working of the Electric vehicle other than the battery of the EV

5.3.  Plan purchased on a defective EV (defective as determined by the company)

5.4.  Any electric vehicle for which the plan has not been activated as per the terms mentioned here

5.5.  Costs implicitly or explicitly covered by any manufacturers, suppliers or repairers guarantee or warranty

5.6.Non-operating and cosmetic defect to the battery of the EV such as defect to paintwork, product finish, dents or scratches

5.7.  Replacement of any consumable item or accessory

5.8.  Normal wear and tear of items not integral to the functioning of the Electric vehicle

5.9.  Coverage will not under any circumstances, extend to any loss or injury to a person or loss or defect to property or any incidental, contingent, special or any direct or indirect loss and consequential defects including but not limiting to losses incurred due to any delay in rendering service related to this Plan and loss of use during the period that the Product is at an authorized service centre and/or while awaiting parts

5.10.             Defect caused by unauthorized repair, theft, burglary and accident including earthquake, storm and or hurricane, abuse, misuse, sand, dust, water, negligence, fire, flood, lightning, malicious defect, impact, corrosion, battery leakage, acts of God, animal or insect infestation or intrusion

5.11.              Defect resulting from power outage, power surges or dips, fluctuating voltage, inadequate or improper voltage or current

5.12.              Cost of removal or re-installation of the battery of the Electric vehicle

5.13.              Reception or transmission problems resulting from external causes

5.14.              Problems or defects not covered under the original Manufacturers’ Warranty / Guarantee

5.15.              Breakdowns caused by computer virus or realignments to the battery of the Electric vehicle

5.16.              Recalls or modifications to the Electric vehicle or its battery

5.17.              Failure to follow the manufacturer’s instructions

5.18.              Costs arising from incorrect installation, modification or maintenance

5.19.              Costs if no fault is found with the Electric vehicle

5.20.              Defect / failure caused before or during the delivery

5.21.        Use of batteries, charger and / or accessories not Approved by the manufacturer, incorrect electrical leads or connection.

5.22.              Any consequential or incidental defects arising from the use or loss of use of the Electric vehicle or its battery

5.23.           If the Electric vehicle or the battery is moved out of the country of purchase, it will not be covered
under this Plan. The Plan is valid only in India and if the claim is made in India

5.24.      The Electric vehicle is not used in accordance with the manufacturer’s guidelines for Electric vehicle usage including but not limited to regular maintenance and up keep of the Electric vehicle.

5.25.             The Electric Vehicle and its battery is explicitly consumed for personal use and not for any commercial/ renting or leasing business

5.26.              The damage to the battery is due to any physical accidents or misuse of the battery of the EV

 

6.    Special Exclusions

Odysse or its subsidiary or any party acting on its behalf shall not be liable in respect of loss or defect to the battery of the Electric vehicle relating to or caused due to the following:

6.1.  Loss or defect due to any experiments or tests and/or alterations resulting to any abnormal conditions of the battery of the Electric vehicle

6.2.  Loss or defect due to electrical break down or derangement, unless such loss is not accidental defect and which is covered within the manufacturer’s warranty during the coverage term of the Manufacturer’s Warranty

6.3.  Penalties for delay or detention or in connection with guarantees of performance or efficiency

6.4.  Loss  to the battery of the Electric vehicle which gradually develops flaws, defects, cracks or partial fractures in any part not necessitating immediate stoppage, although at some future time repair or renewal of the parts affected may be necessary

6.5.  Loss due to deterioration or wearing away or wearing out of any part of the Electric vehicle and its battery that is caused due to or naturally resulting from its normal use or exposure

6.6.  Odysse or its subsidiary or any party acting on its behalf shall not be liable for any loss or defect claim if:

6.6.1.1.        The user is found to be involved in any way in tampering of EV or its battery, fraudulent or illegal activity of any kind whatsoever related to this Plan or Electric vehicle and/or The Plan is purchased for the Electric vehicle after 365 calendar days from the date of purchase of the Electric vehicle or beyond the shorter period of time until the Plan was available for purchase.

6.6.1.2.        Due to the inability of the Customer to submit any of the claim processing information or documents required by Odysse or the risk underwriter for processing the eligible claim

6.7.  The Plan shall also not cover a loss:

6.7.1.1.         Claim amount has exhausted the Covered Value of the battery of the Electric vehicle In any action, suit or other proceeding where the Risk Underwriter alleges that by reason of the provisions of the exceptions or exclusions above, any loss, destruction, defect or liability is not covered by this Plan, the burden of proving that such loss, destruction, defect or liability is covered shall be upon the Customer.

 

7.    Plan Activation Process

On purchase of Plan from Odysse authorised dealer, the Plan will be automatically activated subject to validation of EV eligibility. The Customer will get an automated communication of activation of the Plan through an email on the contact number provided.

 

8.    Damage Repair Request Process

In the event of defect to the battery of the Electric vehicle, you (Customer) are required to:

8.1.  Immediately (Not later than 72 Hours from the time of the defect) inform Odysse through the Odysse Mobile Support App or Odysse Consumer Web Portal (https://Odysse.tech) using your login credentials or write to us at support@Odysse.in detailing how the defect occurred, place of defect, date and time of defect identified, and any documentary evidence of the defect.

8.2.  Submit all claim related information/ documents as mentioned in the Odysse Mobile Support App or web portal within seven (7) calendar days of raising the claim or within the timelines as mentioned in the App or communicated to You by Odysse

8.3.  Please note, you will not handover the Electric vehicle for repairs at any service centre, including at any Authorised Service Centre for Odysse branded electric vehicle until confirmed by Odysse. It is expressly stated that Odysse or its subsidiary or any party acting on its behalf will not be held responsible for fulfilling any such claims where the Electric vehicle is handed over to a service centre by You before the Approval from Odysse; any liabilities arising out of such claim before the in-principal Approval of the claim from Odysse will be solely handled by You at Your own expense

 

9.    Damage Repair Request Fulfilment Process

 

9.1.  You may visit the nearest Authorized Service Centre for Odysse branded electric vehicle. You are required to wait until Odysse confirms in writing via an email or on a voice call on your registered number or provides an update on the Odysse Mobile Support App or on Odysse Consumer Web Portal about the status of the claim and the next steps expected. Service will be performed at the Authorized Service Centres for Odysse branded electric vehicle after verification of the entitlement and validity of the Plan. Once you are notified and that the service (either repair or replacement) is complete, you will promptly be notified via the Odysse Mobile Support App and Odysse Consumer Web Portal. The repaired or replacement of the battery of the EV will be intimated as available for pickup after the repair is completed.

9.2.  Odysse or its subsidiary or any party acting on its behalf reserves the right to change the method by which they may provide repair or replacement service to you, and your Electric vehicle’s eligibility to receive a method of service under this Plan. Service options, parts availability and response times may vary according to the city  and the current serviceable situation when the claim is raised

 

10.  Your Responsibilities

To receive service or support under the Plan, you agree to comply with the following:

10.1.              Provide a copy of your Electric vehicle’s original proof of purchase, if requested

10.2.              Provide information about the reasons and causes of the defect to the battery of Electric vehicle

10.3.              Provide identity proof if requested to verify the Customer of the Plan

10.4.           Respond to requests for information, including but not limited to the Electric vehicle serial number, model, version of the battery, any peripherals EVs connected or installed on the Electric vehicle, actions taken before the Electric vehicle experienced the defect and steps taken to avoid the defect

10.5.              Follow instructions Odysse or its subsidiary or any party acting on its behalf gives you, including but not limited to refraining from sending Electric vehicle that is not subject to defect protection as per the Plan and packing the battery of the Electric vehicle in accordance with shipping instructions

 

11.  Cancellation and Refund

This Plan is non-cancellable and no refunds will be issued

 

12.  Limitation Of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Odysse, its subsidiary or any party acting on its behalf ODYSSE AND ITS EMPLOYEES AND AGENTS WILL UNDER NO CIRCUMSTANCES BE LIABLE TO YOU OR ANY SUBSEQUENT OWNER FOR ANY INDIRECT OR CONSEQUENTIAL DEFECTS, INCLUDING BUT NOT LIMITED TO COSTS OF RECOVERING, REPROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA OR THE FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA, ANY LOSS OF BUSINESS, PROFITS, REVENUE OR ANTICIPATED SAVINGS, RESULTING FROM ODYSSE’S OBLIGATIONS UNDER THIS PLAN. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LIMIT OF ODYSSE AND ITS’ EMPLOYEES AND AGENT’S LIABILITY TO YOU ARISING UNDER THE PLAN SHALL NOT EXCEED THE RESIDUAL VALUE OF THE BATTERY OF THE ELECTRIC VEHICLE. ODYSSE SPECIFICALLY DOES NOT WARRANT THAT (i) IT WILL BE ABLE TO REPAIR OR REPLACE THE BATTERY OF THE ELECTRIC VEHICLE WITHOUT RISK TO OR LOSS OF PROGRAMS OR DATA, (ii) IT WILL MAINTAIN THE CONFIDENTIALITY OF DATA, OR (iii) THAT THE OPERATION OF THE PRODUCT WILL BE UNINTERRUPTED OR ERROR- FREE. ODYSSE’S LIABILITY IS LIMITED, AT ITS SOLE OPTION, TO REPLACE OR REPAIR OF THE BATTERY OF THE ELECTRIC VEHICLE OR SUPPLY OF THE SERVICE

 

13.  General Terms

13.1.              Odysse may subcontract or assign performance of its obligations to third parties but shall not be relieved of its obligations to you in doing so

13.2.              Odysse is not responsible for any failures or delays in performing under the Plan that are due to events outside its reasonable control

13.3.              This Plan is offered and valid only if you are making a claim in India

13.4.              This Plan may not be available in all states, and is not available where prohibited by law

13.5.             In carrying out its obligations Odysse or its subsidiary or any party acting on its behalf may, at their discretion and solely for the purposes of monitoring the quality of their response, record part or all the calls between you and them

13.6.              You agree that any information or data disclosed to Odysse under this Plan is not confidential or proprietary to you. Furthermore, you agree that Odysse may collect and process data on your behalf when it provides service. This may include transferring your data to Odysse or its affiliated companies or service providers in accordance with the Customer Privacy Policy of Odysse, details of which are available on its website under Odysse.tech/privacy/

13.7.              Odysse or its subsidiary or any party acting on its behalf have security measures, which should protect your data against unauthorized access or disclosure as well as unlawful destruction. You will be responsible for the instructions you give to Odysse or its subsidiary or any party acting on its behalf regarding the processing of data, and Odysse or its subsidiary or any party acting on its behalf will seek to comply with those instructions as reasonably necessary for the performance of the service and support obligations under the Plan.

13.8.              The terms of the Plan, including the original sales receipt of the Electric vehicle and the Plan Confirmation, prevail over any conflicting, additional, or other terms of any purchase order or other document, and constitute your and Odysse’s entire understanding with respect to the Plan

Odysse or its subsidiary or any party acting on its behalf is not obligated to renew this Plan. If either Odysse or its subsidiary or any party acting on its behalf does offer a renewal, they will determine the price and terms

13.10.           There is no informal dispute settlement process available under this Plan

13.11.      In the event any section or portion of a section of these terms and conditions are deemed invalid, void or unenforceable, that section or portion of a section shall be severed from these terms and conditions, and the remaining terms and conditions shall continue in full force and effect. These terms and conditions shall be governed by and construed under the laws of India

13.12.           These terms and conditions do not affect your statutory rights as a consumer

13.13.           Odysse reserves the right, at its discretion, to change or modify, the terms of this Plan
